Shopify Data & Analytics

Our online store is hosted on Shopify. Shopify provides us with the e-commerce platform that allows us to sell our products and services to you. In doing so, Shopify collects and processes Personal Data about you on our behalf and for its own legitimate purposes, including device and usage information, browsing activity, purchase behavior, and analytics insights. Shopify may use cookies, automated tools, and machine learning ("Shopify Intelligence") to help us better understand our customers, detect fraud, and improve our services. SMS / Text Message Marketing Program

This section describes our practices regarding the SMS / text message marketing program operated by SARTORIA OPERA PRIMA SRL (d/b/a LePARMENTIER Paris) and complies with applicable laws including, where relevant, the United States Telephone Consumer Protection Act (TCPA, 47 U.S.C. § 227), the Cellular Telecommunications Industry Association (CTIA) Messaging Principles and Best Practices, Canada's Anti-Spam Legislation (CASL, S.C. 2010, c. 23), the European Union's General Data Protection Regulation (Regulation (EU) 2016/679, "GDPR"), the EU ePrivacy Directive (2002/58/EC), and Italian Legislative Decree No. 196/2003 ("Codice Privacy") as amended.

1. Consent and Enrollment. By providing your mobile telephone number through one of our enrollment channels (including, without limitation, our website checkout, account registration form, signup form, or text-keyword enrollment), and by affirmatively checking the SMS opt-in box or otherwise expressly indicating your consent, you provide your express written consent to receive recurring automated marketing and informational text messages from LePARMENTIER Paris at the mobile number you provide. Consent is not a condition of any purchase.

2. Categories of Messages. By opting in, you may receive the following categories of messages: (a) promotional messages, including notifications regarding new arrivals, restocks, exclusive offers, sales, and brand updates; (b) transactional messages, including order confirmations, shipping notifications, delivery updates, and review requests; (c) cart-abandonment reminders; and (d) customer service messages and responses to your inquiries.

3. Message Frequency, Costs, and Carrier Disclaimer. Message frequency is recurring and varies based on your interaction with our services. Message and data rates may apply according to your mobile carrier's plan. Mobile carriers are not liable for delayed or undelivered messages.

4. Opting Out (Right of Withdrawal). You may revoke your consent and withdraw from our SMS marketing program at any time, free of charge, by replying STOP to any message you receive from us. To request assistance, reply HELP. Following receipt of a STOP request, we will send a single confirmation message and cease sending you marketing text messages. Opting out of SMS marketing does not affect your subscription to other communication channels (such as email) or your ability to make purchases through our website. To re-subscribe, you must affirmatively re-enroll.

5. How We Determine When to Send Cart-Abandonment Messages. Our website uses cookies and similar tracking technologies to identify products you have added to your shopping cart and to determine when you have abandoned your checkout without completing a purchase. This data — including the items in your cart, your shopping session identifier, and the time elapsed since cart abandonment — is collected automatically when you interact with our website. We use this information solely to determine when and whether to send you a cart-reminder text message, and only if you have provided express consent to receive SMS communications from us.

6. Service Provider and Data Processor. We use Klaviyo, Inc. ("Klaviyo") as our exclusive SMS messaging service provider and data processor. Klaviyo processes your mobile telephone number and SMS opt-in data on our behalf for the sole purpose of operating our SMS marketing program. Klaviyo's processing is governed by a data processing agreement consistent with applicable data protection laws (including, where relevant, GDPR Article 28). For information regarding Klaviyo's privacy practices, please consult Klaviyo's Privacy Policy at https://www.klaviyo.com/legal/privacy.

7. Limitations on Sharing of SMS Opt-In Data and Consent. Notwithstanding any other provision of this Policy, your mobile telephone number, your SMS opt-in selection, and your consent to receive text messages constitute a separate category of personal data that is NOT shared, sold, rented, leased, transferred, or otherwise disclosed to any third party for any purpose other than enabling and operating our SMS marketing program. Specifically: (a) this data is shared only with Klaviyo, our messaging service provider, acting as our data processor; (b) any reference elsewhere in this Policy or in our Terms of Service to the sharing, selling, or transferring of personal data with third parties (whether affiliated or non-affiliated) does NOT apply to your SMS opt-in data or consent; and (c) we do not and will not include SMS opt-in data in any sale or sharing of personal data, including for purposes of cross-context behavioral advertising under the California Consumer Privacy Act (CCPA) / California Privacy Rights Act (CPRA), the Colorado Privacy Act, the Connecticut Data Privacy Act, the Virginia Consumer Data Protection Act, or the Utah Consumer Privacy Act.

8. Data Retention. We retain your mobile telephone number and SMS opt-in records for as long as you remain enrolled in our SMS marketing program plus a reasonable period thereafter to comply with our legal obligations, resolve disputes, and enforce our agreements. After this period, we will securely delete or anonymize this data.

9. Your Additional Rights. In addition to your right to opt out of SMS messaging at any time as described in Section 4 above, you retain all rights described elsewhere in this Privacy Policy, including the right to access, rectify, delete, port, or object to the processing of your personal data. To exercise these rights, please use the contact information provided at the end of this Policy.

International Data Transfer and Storage

Where possible, we store and process data on servers within the general geographical region where you reside (note: this may not be within the country in which you reside). Specifically, for European based companies, we have servers in the European Economic Area (EEA). Your Personal Data may also be transferred to, and maintained on, servers residing outside of your state, province, country or other governmental jurisdiction where the data laws may differ from those in your jurisdiction. We will take appropriate steps to ensure that your Personal Data is treated securely and in accordance with this Policy as well as applicable data protection law. Data may be kept in other countries that are considered adequate under your laws.
